Terms of Service

By browsing myayatech.netlify.app, creating an account, submitting a project brief or engaging us on work, you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

We provide software engineering, web and mobile platform development, AI and automation, cloud architecture, and ongoing support. Each engagement is defined in a separate written proposal or statement of work covering scope, deliverables, milestones and fees. Where a signed agreement conflicts with these terms, that agreement prevails.

You are responsible for the accuracy of the details you provide and for keeping your credentials secure. Notify us immediately at Josphatmyaya@hotmail.com if you suspect unauthorised access. We may suspend accounts used for abuse, fraud or illegal activity.

Submitting a brief through this site is a request, not a binding contract. Work begins only once scope and fees are agreed in writing. Estimates are based on the information you supply; material changes to scope may adjust cost and timeline.

Unless stated otherwise in a statement of work, engagements run on milestone billing with a deposit due before work starts, and invoices payable within 14 days. Late amounts may pause delivery. Third-party costs — hosting, domains, APIs, licences — are billed at cost or paid directly by you.

Timely feedback, access to required systems and accurate content are needed to hit agreed dates. Delays in these shift the delivery schedule accordingly.

This website, the MYAYA TECHNOLOGIES name, logo and all site content belong to MYAYA TECHNOLOGIES. For client work, ownership of custom deliverables transfers to you upon full payment. We retain ownership of our pre-existing tools, libraries and know-how, and grant you a perpetual licence to use them within the delivered solution. Third-party and open-source components remain under their own licences.

Unless you ask us in writing not to, we may reference the engagement and show non-confidential visuals of the delivered work in our portfolio and case studies.

Each party will protect the other's non-public information and use it only to perform the engagement. This obligation survives the end of the project.

Do not attempt to breach, overload, scrape at scale, reverse-engineer or interfere with this site or its backend, and do not submit unlawful, infringing or malicious content through our forms.

We warrant that delivered work will materially conform to the agreed specification and will fix qualifying defects reported within 30 days of delivery at no charge. Beyond that window, or for changes outside the original scope, support is provided under a maintenance agreement. The site itself is provided "as is" without further warranty.

To the fullest extent permitted by law, MYAYA TECHNOLOGIES is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total aggregate liability for any claim is limited to the fees you paid us for the engagement giving rise to the claim in the preceding six months.

Either party may end an engagement with 14 days' written notice. You pay for work completed and committed costs up to the termination date; we hand over completed deliverables for which payment has been received.

Our work may integrate services we do not control. We are not responsible for their availability, pricing changes or terms.

These terms are governed by the laws of the Republic of Zambia, and the courts of Zambia have exclusive jurisdiction over any dispute. We will attempt good-faith resolution before any formal proceedings.

We may update these terms; the effective date above will change and continued use of the site means you accept the update.
